1. Introduction

Acceptance of Terms: By using The Pool Nerd ("the site"), you agree to these Terms and Conditions and to our Privacy Policy. If you do not agree, please do not use the site.
Accounts and submissions: By selecting "Create account" or submitting a question, comment, photo or other contribution, you confirm that you have read and agree to these Terms, including the moderation and content-licence provisions below.
Scope: These terms apply to all visitors, users, and others who access or use the site, including anyone who creates an account.

2. Use of the Site

Permitted Use: The site is for personal, non-commercial use only.
Prohibited Activities: You agree not to engage in activities that could harm the site, other users, or the site's functionality, including scraping, automated posting, attempting to bypass security rules or upload limits, or interfering with moderation.

3. Accounts

Eligibility: You must be at least 18 years old to create an account.
Your details: Provide a real email address you control. Your display name is shown publicly next to your comments; do not use a name that impersonates another person, a business or The Pool Nerd.
Security: Keep your password private. You are responsible for activity on your account. Tell us promptly if you believe it has been used without your permission.
One person, one account: Do not create accounts for other people or to evade a restriction we have placed on an existing account.
Ending or restricting an account: You can stop using your account at any time and ask us to delete it (see the Privacy Policy). To the fullest extent permitted by law, we may suspend, restrict, disable or delete any account, block future registrations or submissions, or limit access to any part of the site at any time, with or without notice, when we believe it is necessary to protect the site, our users or The Pool Nerd, enforce these Terms, or address misuse or legal risk.

4. Intellectual Property Rights

Ownership: All content on The Pool Nerd, including text, graphics, logos, and images, is the property of The Pool Nerd or its content suppliers and protected by copyright and other intellectual property laws.
Restrictions: Reproduction, distribution, or commercial use of any content is prohibited without express permission.

5. Affiliate Disclaimer

Affiliate Links: The Pool Nerd participates in various affiliate marketing programs, which means we may get paid commissions on purchases made through our links to retailer sites.
Neutrality: Our content is not influenced by the affiliate partnerships.

6. Questions, Comments, Photos and Other User Content

What this section covers: "User Content" includes every question, comment, reply, review, correction, display name, photo and other material you submit through an account or otherwise send for publication. User Content is voluntary, is not confidential, and may become publicly visible with your display name.
Your promises: You represent and warrant that you own your User Content or have every permission needed to submit it; that it is accurate to the best of your knowledge; and that our permitted use of it will not violate any law or anyone else's copyright, trademark, privacy, publicity, contractual or other rights. You remain solely responsible for your User Content and any consequences of submitting it.
Content that is not allowed: Do not submit content that is unlawful, infringing, defamatory, threatening, harassing, hateful, discriminatory, obscene, sexually exploitative, deceptive, dangerously misleading, invasive of privacy, impersonating, fraudulent, spam, advertising, solicitation or malicious code. Do not disclose another person's private information or include a person in a photo without permission. Content must be relevant to the discussion and must not promote unsafe conduct or interfere with the site or moderation process.
Photos and files: You may attach only photos you took or have the legal right to share. We may set or change limits on file size, type, dimensions, quality, storage period and number of uploads; resize, crop, compress or reformat files; or reject or delete any file.
All submissions are moderated: Submission does not create a right to publication. Every contribution is subject to review before and after it appears publicly, and publication may be delayed or denied. Edited contributions may return to the moderation queue.
Our moderation discretion: To the fullest extent permitted by law, The Pool Nerd may, but is not required to, monitor, screen, review, approve, reject, edit, redact, crop, reformat, move, reclassify, limit the visibility or distribution of, hide, disable access to, archive or permanently delete any User Content before or after publication. We may do so at any time, for any reason or no stated reason, including where content otherwise complies with these Terms, without prior notice, explanation, compensation or an opportunity to appeal. Our moderation decisions are final, and we have no obligation to publish, retain, restore or provide a copy of User Content.
Enforcement: We may warn a user; place a contribution back into review; restrict posting or uploading; suspend, ban or delete an account; block attempts to create another account; preserve relevant records; or report content and cooperate with courts, regulators or law enforcement where we believe action is appropriate or legally required.
No duty and no endorsement: Moderation does not mean that we endorse, verify or accept responsibility for User Content, and it does not create a duty to monitor every submission or remove content within a particular time. Opinions expressed by users belong solely to those users.
Licence to The Pool Nerd: You retain any ownership rights you have. By submitting User Content, you grant The Pool Nerd a worldwide, non-exclusive, royalty-free, transferable and sublicensable licence to host, store, reproduce, modify, adapt, crop, reformat, publish, translate, distribute, publicly display and otherwise use that content, together with your display name, as reasonably needed to operate, moderate, improve and promote the site and The Pool Nerd's related channels in any media. Where permitted by law, you waive moral rights and agree not to assert them against those uses. The licence continues for copies, backups, legal or moderation records, and materials created while the content was posted, subject to the Privacy Policy and any rights that applicable law does not allow you to waive.
Deletion and retention: You may delete your own comments through the site where that option is available or request account deletion as described in the Privacy Policy. Deletion may not be immediate or remove copies already included in backups, security or audit records, legal files, search caches, or materials created before deletion. We may retain non-public copies where reasonably necessary for fraud prevention, safety, dispute resolution, legal compliance or enforcement of these Terms.
Questions and answers: We do not promise to answer a question, publish an answer or respond within any period. Answers from The Pool Nerd or other users are general information, not professional, engineering, electrical, medical or legal advice. Verify safety-critical information with the manufacturer or an appropriately licensed professional before acting.

7. Email List

Joining and leaving: You can join our email list from the subscribe box on our Deals page, or when you create an account or sign in, for emails about new reviews, deals and pool tips. Only enter an email address you own. You can unsubscribe at any time from your account page or from any email we send. Account emails, such as password resets and verification, are sent regardless.
No fixed schedule: We do not promise a weekly or other fixed sending schedule. Email timing and frequency may change.

8. Links to Other Websites

Third-Party Links: Our site may contain links to third-party websites or services that are not owned or controlled by The Pool Nerd.
No Responsibility: The Pool Nerd has no control over, and assumes no responsibility for the content, privacy policies, or practices of any third-party websites or services.

9. Disclaimers and Limitation of Liability

No Warranties: The site and its content, including comments posted by readers, are provided "as is". The Pool Nerd makes no warranties regarding the accuracy, reliability, or completeness of the content.
Moderation and accounts: To the fullest extent permitted by law, The Pool Nerd is not liable for publishing, delaying, editing, rejecting, restricting or deleting User Content; failing to monitor or remove User Content; suspending or deleting an account; or losing User Content.
Limitation of Liability: To the fullest extent permitted by law, The Pool Nerd will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss arising from use of or inability to use the site or its content, reliance on User Content, or anything posted by another user. Nothing in these Terms excludes liability that applicable law does not allow us to exclude.

10. Indemnification

To the fullest extent permitted by law, you agree to defend, indemnify and hold harmless The Pool Nerd and its affiliates, officers, agents, employees, and partners from claims, liabilities, damages, judgments, losses, costs and reasonable legal fees arising from your User Content, your use of the site, your violation of these Terms, or your violation of another person's rights.

11. Modification of Terms

Right to Modify: The Pool Nerd reserves the right, at our sole discretion, to modify or replace these Terms at any time. The date at the top shows when they last changed. Continuing to use the site after a change means you accept the new terms.

12. Governing Law

Jurisdiction: These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

13. General Terms

Entire agreement: These Terms and the Privacy Policy are the entire agreement between you and The Pool Nerd concerning use of the site.
Severability: If a provision is found unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will continue in effect.
No waiver: A delay or failure to enforce a provision is not a waiver of our right to enforce it later.
Assignment: You may not transfer your rights or obligations under these Terms without our written consent. We may assign these Terms as part of a reorganization, sale, transfer or operation of the site.
